Neutral Evaluation
Neutral Evaluation is a voluntary, consensual, non-binding process in which a Neutral evaluates the merits of a dispute. Each side has an opportunity to present information and supporting arguments regarding their case. The Neutral will evaluate, based on his/her expertise, the strengths and weaknesses of the claims, supporting evidence and possible outcomes. The Neutral’s evaluation is a form of legal information that is provided impartially. Neutral Evaluation is not a confidential process unless the parties agree otherwise in writing. However, the Neutral Evaluator’s assessment, statements, and work product shall not be admissible in any judicial, administrative, or regulatory proceeding. Neutral Evaluation offers a way for parties to gather information as a means to resolving their dispute.
All parties must be represented by counsel unless The McCammon Group gives consent in exceptional circumstances.
